29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    At Baltazar's Stone, Inc.:   The employer failed to ensure the development and implementation of a written energy control program consisting of energy control procedures ; training of affected, authorized and other employees; and periodic inspections. Employees of the company are required to perform or they are exposed to unexpected start-up or release of stored energy during maintenance or service operations. Equipment identified by the employer after the inspection as meeting the criteria under 29CFR 1910.147(a)(2)(i) thru 29CFR 1910.147(a)(2)(ii)[B] include but are not limited to:    1. 29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  At Baltazar's Stone Inc. : The employer failed to provided acceptable training per OSHA requirements for employees permitted to operate powered industrial vehicles. Prior to the inspection the employer had only discussed powered industrial vehicle operation with employees rather than providing a training program that consisted of class room instruction, hands on training and evaluation. Employees are using the blade of the saw to perform specialty type cuts that place employee's hands within the point of operation exposing them to potential amputation hazards.

Baltazar's Stone, Inc.:     The employer did not completely fill out the 2013, OSHA 300 Log completely in that: On the 2013 OSHA 300 an injury that occured on 10-2013 was not recorded as a loss time incident in which the employee missed approximately one week of work and was placed on restrictions upon return to work.
