29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition:    a) Worksite, 11 Berger Ave. Amityville NY - Employee was using a pneumatic nail gun to install asphalt shingles on the roof of a two story residential home.  The employee was not using eye protection; on or about 11/29/13.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      a)  Worksite, 11 Berger Ave. Amityville NY - Employee was not wearing a protective helmet and was exposed to being struck by asphalt shingles and tools while walking and working below overhead roofing work; on or about 11/29/13.     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.    B.A.C. Systems Inc. was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.100(a), which was contained in OSHA inspection number 311139786, citation number 1, item number 1, and was affirmed as a final order on 12/21/09, with respect to a workplace located at Conklin Ave, Farmingdale NY 11735.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.      a)  Worksite, 11 Berger Ave. Amityville NY- Employees were installing tar paper and asphalt shingle on the roof of a two story residential home.  The employees were not protected from falling approximately 25ft to the ground below; on or about 11/29/13.     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.      B.A.C. Systems Inc. was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 311139786, citation number 1, item number 2, and was affirmed as a final order on 12/21/09, with respect to a workplace located at Conklin Ave, Farmingdale NY 11735.
