29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury. (a)Delta Construction dba GH Phipps of Wyoming@ 1687 Broadway, Boulder, CO 80304: On and before November 16th, 2013, the controlling employer did not ensure that a superintendent tasked in overseeing the jobsite was instructed in the recognition and avoidance of unsafe conditions associated with steel erection activities on-site. Subcontractor steel erection employees were engaged in placing roof deck panels and conducting final deck attachments simultaneously while working at heights over 30 feet, without an adequate fall protection system. This condition exposed subcontractor employees to a fall hazard of approximately 33 feet to 37 feet.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: (a)Delta Construction, Inc. dba GH Phipps of Wyoming @ 1687 Broadway, Boulder, CO 80304: On and before November 16th, 2013, the controlling employer did not ensure that subcontractor employees working on the roof of a commercial building under construction, were protected from fall hazards. Subcontractor steel erection employees were engaged in placing roof deck panels and conducting final deck attachments simultaneously while working at heights over 30 feet, without an adequate fall protection system. This condition exposed subcontractor employees to a fall hazard of approximately 33 feet up to 37 feet.
