29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  (a)  APPROXIMATELY 127 NORTH 3RD STREET, READING, PA - The foreman of the site where employees were working in a trench at a depth of approximately six (6) feet failed to recognize that protective measures were required to protect the employees from cave-in hazards, thereby exposing the employees in the trench to possible injuries, on or about December 2, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a)  APPROXIMATELY 127 NORTH 3RD STREET, READING, PA - The employer did not provide training to employees that would have allowed the employees to recognize the hazards of the trench that they were working in, to include the observed hazards of working in a trench at a depth of approximately six (6) feet deep without a protective system, and the undermined sidewalk and roadway areas adjacent to the trench, on or about December 2, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):  (a)  APPROXIMATELY 127 NORTH 3RD STREET, READING, PA - Employees performed work in a trench at a depth of approximately six (6) feet, where the trench was not protected by an adequate protective system, thereby exposing the employees to possible serious injuries, on or about December 2, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:  (a)  APPROXIMATELY 127 NORTH 3RD STREET, READING, PA - Employees performed work in a trench, where portions of the walls of the trench had been dug out from underneath the adjacent sidewalk and no method had been used to prevent the collapse of the sidewalk, thereby exposing employees to possible injuries, on or about December 2, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
