Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing/struck-by hazards: (a) On or about November 19, 2013, and at times prior, for employees working in the maintenance bay operating the BendPak two-post lift, Model #MX10ACX with Serial Number 51446, and exposed to a crushing/struck-by hazard where the contact pads were missing from the contact plates at Quality Auto Body, Inc. dba Quality Auto at 404 25th Street, Fargo, North Dakota.
