29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  a) In the tank yard, on or about and at times prior to November 25, 2013, the employer did not establish a written permit required confined space program for an employee was required to make entry into and to perform cleaning work in a 21,000 gallon flat bottom storage tank that was used to process food grade used cooking oil, exposing the employee to the hazards associated with death, asphyxiation, and loss of consciousness.  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a) In the tank yard, on or about and at times prior to November 25, 2013, the employer did not establish a respiratory protection program for an employee who was required to wear a North half-face cartridge style respirator while removing cooking oil from the inside of 21,000 gallon storage tanks and from the back of tractor trailers used in the transportation of used cooking oil, exposing the employee to the hazards associated with respiratory distress.  ABATEMENT CERTIFICATION IS REQUIRED
