29 CFR 1926.304(i)(1): Each circular hand-fed ripsaw was not guarded by a hood whcih completely enclosed that portion of the saw above the table and that portion of the saw above the material being cut. a) Worksite - Employees were using a 10 inch Ryobi Table Saw to cut styro foam. The guard was removed from the saw, exposing a portion of the blade; on or about 12/3/13. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) a) Worksite - Employee was exposed to falling while working from the second tier of a fabricated frame scaffold approximately 12ft above the ground; on or about 12/3/13. b) Worksite - Employee was exposed to falling while working from the third tier of a fabricated frame scaffold approximately 18ft above the ground; on or abouit 12/3/13. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19. This employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 315332320, citation number 2, item number 2, and was affirmed as a final order on 1/4/12, with respect to a workplace located at 1 Keewaydin St. Lawrence NY 11559. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) Worksite - Employees were installing styro foam to the exterior of a two story residential home while working from the platform of a fabricated frame scaffold. The employees were climbing the crossbraces to gain access to the scaffold; on or about 12/3/13. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
