OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards:  Southwest area, south end of the workplace: Employees were exposed to fire hazards from contact with burning combustible particulate solids/combustible dust accumulated upon operating equipment used to support shredder activities such as, but not limited to, conveyor systems, conveyor support structures, and conveyor support equipment. Housekeeping operations with regular cleaning frequencies were not conducted for walls, floors, pipes, hoods, ledges, beams, and above suspended ceilings and other concealed surfaces, to minimize dust accumulation within operating areas of the facility. The workplace housekeeping requirements are described in Section 8.2 Housekeeping--Standard Number 654-National Fire Protection Association: "Standard for the prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids".

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.:  Southwest area, south end of the workplace: Employees engaged in workplace activities were exposed to struck-by hazards from equipment including but not limited to:  a) Shredder Machine ZTS 2000 rotating parts whose enclosure guard was missing on the day of the inspection.       The unguarded machine access opening was 10 inches long by 7 inches wide, at a height of 48 inches above      the workplace floor, with internal parts rotating at 45 rev/min,  b) Conveyor Belt ZTS 2000 Infeed moving parts whose enclosure guard was missing on the day of the inspection.       The unguarded conveyor belt opening was 12 inches long by 4 inches wide, at a height of 48 inches above the floor, with        a belt speed of 26 meters/minute.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):  Southwest exterior area of the workplace, north end of the worksite: Employees engaged in workplace activities were exposed to shock hazards from contact with exposed, bare ends of three insulated conductors and a single bare ground wire. The conductors operated at 440 volts AC, were located at a height of 12 inches above the ground; and were part of a 4 conductor flexible cord connected to a junction box for the missing emission control ventilation motor.

29 CFR 1910.305(b)(2)(i): Each outlet box in completed installations did not have a cover, faceplate, or fixture canopy:(a)   Southwest area, south end of the workplace: Employees engaged in workplace activities were exposed to shock hazards from contact with an energized duplex receptacle, installed within an enclosure mounted upon a building support column and missing a cover. The duplex receptacle was located 48 inches above the workplace floor and operated at 120 volts AC.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure:  North end of the workplace, adjacent to exit door: Employees engaged in workplace activities were exposed to electric shock hazards from contact with light within a wall mounted enclosure powered by a flexible cord used in place of fixed wiring. The flexible cord that powered the light switch was mounted at a height of 56 inches and operated at 120 volts AC.

29 CFR 1910.307(c)(2): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not safe for the hazardous (classified location), nor approved for the hazardous (classified) location or the ignitable or combustible properties of the specific gas, vapor, dust or fiber that was present:  Southwest area, south end of the workplace: Employees engaged in workplace activities were exposed to struck-by hazards from electrical equipment not approved for hazardous locations where combustible dust was present. The equipment used in support of workplace operations and not approved for Class II, Division II locations, included but was not limited to, the following:   a) Electrical equipment for the ZTS 2000 Shredder Machine System that operated at 440 volts AC, at a height of 12 inches above the floor and included two Shredder Drive Motors,  b) Electrical equipment that supported the Conveyor for the ZTS 2000 Shredder Machine that operated at 440 volts AC, at a height of 48 inches above the floor and included one 2 horsepower Conveyor Drive Motor,   c) Electrical equipment for the ZTTS 2000 Shredder Machine System that operated at 440 volts AC, at a height of 12 inches above the floor and included two Shredder Drive Motors,  d) Electrical equipment that supported the Conveyor for the ZTTS 2000 Shredder Machine that operated at 440 volts AC, at a height of 48 inches above the floor and included one 2 horsepower Conveyor Drive Motor.
