29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, shall be used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one.  On December 3, 2013, employees were dropping materials from over 20 feet above the ground without the use of a chute, thereby exposed employees to the hazards associated with free falling debris.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.    On December 3, 2013, employees conducting roofing operations, twenty-two (22) feet above the ground, were not protected from falls.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(3).

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    On or about December 3, 2013, employees were exposed to a fall while working on a commercial property and were not provided with training to recognize and minimize the hazards associated with falls.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  On December 3, 2013, employees were using a metal extension ladder with a damaged cleat was not removed from service, thereby exposing employees to the hazards associated with falls.
