29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible engineering controls were not utilized:    The employer did not use engineering controls for an employee with the following overexposure:     a) Dryer/chopper room: A machine operator was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Permissible Exposure Limit). The employee's dosimeter dBA level was 135.9% of the permissible level (90 dBA) and was equivalent to approximately 92.2 dBA. The sampling was performed for 427 minutes during one shift on 2/25/14.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:     The employer did not establish and maintain a baseline and annual audiometric testing program for employees with the following overexposures:     a) Grating room: A supervisor was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). The employee's dosimeter dBA level was 70.8 % of the permissible level (90 dBA) and was equivalent to approximately 87.5 dBA. The sampling was performed for 413 minutes during one shift on 2/25/14. Zero exposure was assumed for the unsampled period of time.     b) Grating room: A packager was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). The employee's dosimeter dBA level was 96.34 % of the permissible level (90 dBA) and was equivalent to approximately 89.7 dBA. The sampling was performed for 404 minutes during one shift on 2/25/14. Zero exposure was assumed for the unsampled period of time.       c) Cup room: A packager was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). The employee's dosimeter dBA level was 75.1  % of the permissible level (90 dBA) and was equivalent to approximately 87.9 dBA. The sampling was performed for 396 minutes during one shift on 2/25/14. Zero exposure was assumed for the unsampled period of time.         d) Dryer/chopper room: A supervisor was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Action Level). The employee's dosimeter dBA level was 98 % of the permissible level (90 dBA) and was equivalent to approximately 89.9 dBA. The sampling was performed for 429 minutes during one shift on 2/25/14. Zero exposure was assumed for the unsampled period of time.         e) Dryer/chopper room: A machine operator was exposed to continuous noise levels in excess of the allowable 8-hour time-weighted average sound level (Permissible Exposure Limit).
