29 CFR 1926.95(a):  Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  (a) At the jobsite - on or about December 3, 2013 - employees were installing roof shingles with pneumatic nail guns without wearing eye protection, such as safety glasses with side shields.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   (a) At the jobsite - on or about December 3, 2013 - a fall hazard of approximately 17 feet existed when employees were installing roof shingles on a 7 on 12 pitched roof deck without any conventional fall protection.
