29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:             (a)               Water Engineering, Inc., 3905 Niagara St., Unit 6, Denver, CO 80207:  The employer did not maintain at the workplace a site specific written hazard communication program which describes how the specified in paragraphs (f), (g), and (h) of this section for labels of warning, safety data sheets, and employee information and training will be met.  This condition exposed employees to chemical hazards associated with chemicals such as Formula 1401, Formula 1535, and Formula 1810.       Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.1200(f)(1): The chemical manufacturer, importer, or distributor shall ensure that each container of hazardous chemicals leaving the workplace is labeled, tagged or marked with the following information:    (a)   Water Engineering, Inc., 3905 Niagara St., Unit 6, Denver, CO 80207:  On and before December 4, 2013, a  container of glycol was inadequately labeled. The bucket label consisted of "Glycol"written in marker on the container. The labeling was lacking hazard warnings, and the name and address of the chemical manufacturer, importer, or other responsible party.      Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

This condition may result in employees using chemicals in an unsafe manner due to lack of knowledge about the chemicals. The employer did not have any SDSs on hand, nor the ability to access electronic copies. 29 CFR 1910.1200(h)(1):  Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.      (a)   Water Engineering, Inc., 3505 Niagara St., Unit 6, Denver, CO 80207: On and before December 4, 2013 the employer did not provide employees with information on the health hazards of the chemicals they are working with. 29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard  assessment had been performed through a written certification which included the  requirements as outlined in 29 CFR 1910.132(d)(2):     (a)   Water Engineering, Inc., 3505 Niagara St., Unit 6, Denver, CO 80207: On and before December 4, 2013 the employer did not ensure through written verification that a workplace personal protective equipment (PPE) hazard assessment had been performed.     Abatement Note: The employer shall verify that the required workplace assessment has been performed through a written certification that shall include the following:       1)   Identifies the workplace evaluated;       2)   The person certifying that the evaluation has been performed;       3)   The date(s) that the hazard assessment was performed; and       4)   Which identifies the document as a certification of hazard assessment.
