29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  On or about December 4, 2013 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to fall hazards.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:   a.  On or about December 4, 2013 - at the above addressed jobsite, an employee using the JLG Telescopic Boom Aerial Lift truck was not trained to recognize the hazards associated with the use of aerial lifts, thereby exposing the employee to the hazards associated with falls.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  a.  On or about December 4, 2013 - at the above addressed jobsite, an employee working in the JLG Telescopic Boom Aerial was not attached to the boom or basket by the use of a body harness and lanyard, thereby exposing the employee to the hazards associated with falls.

Except as provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee on a walking/working surface 6 feet (1.8 m) or more above lower levels shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system.  a. On or about December 4, 2013 - at the above addressed jobsite, an employee conducting metal framing operations from a structural beam approximately twelve (12) feet above the ground was not protected from falling, thereby exposing the employee to fall hazards.
