29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  a) Basement, East Wall - An electrical receptacle box, 110 volt 20 ampere was observed suspended by its electrical romex cable not mounted with extension cords plugged into it exposing workers to an electrical shock hazard, on or about 12/03/13.   This contractor is the general contractor for the site, thusly; they are the controlling and correcting employer for the site. The superintendent and assistant superintendent stated they conduct daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that they were aware of the operations in progress. Either the assistant superintendent or the superintendent are on site when work is in progress. This contractor is being cited Under the Multi-Employer Workplace Policy in addition to having exposed employees to this hazard.

29 CFR 1926.403(i)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosures, nor by any of the means listed in subparagraphs (A) through (D) of this paragraph:  a) Basement, East Wall - An electrical panel, 110 volt 150 ampere, was observed with the cover removed and an electrical receptacle box directly below it exposing the workers to a potential electrical shock, on or about 12/03/13.   b) Basement, East Wall - An electrical receptacle box, 110 volt 20 ampere, was observed with the cover missing exposing the workers to a potential electrical hazard, on or about 12/03/13.   This contractor is the general contractor for the site, thusly; they are the controlling and correcting employer for the site. The superintendent and assistant superintendent stated they conduct daily inspections and is continuously monitoring all operations. The superintendent stated in his interview that they were aware of the operations in progress. Either the assistant superintendent or the superintendent are on site when work is in progress. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) 1st Floor South Side or Rear of the Building - A foreman and a glass carpenter were observed without fall protection while working near and at the edge of the door opening exposing them to a 10 foot 6 inch fall hazard, on or about 12/03/13.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.   This contractor is the general contractor for the site, thusly; they are the controlling and correcting employer for the site. The superintendent and assistant superintendent stated they conduct daily inspections and is continuously monitoring all operations. 29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:   a) North Side of the Building - An assistant superintendent was observed entering the building using the job made stairs which was not equipped with a standard handrail exposing him to a 5 ½ foot fall hazard, on or about 12/03/13.    b) Stairs between 1st & 2nd  and 2nd & 3rd  Floors - An owner and an assistant superintendent were observed using the stairs which was not equipped with a standard handrail exposing them to a 10 foot fall hazard, on or about 12/03/13.   c) Stairs Entering the Basement - A company owner and a tile worker were observed entering the basement unit using the permanent stairs which was not equipped with a standard handrail exposing them to a 2 ½ foot fall hazard, on or about 12/03/13.   Abatement certification required within 10 days after abatement date.
