29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: a. On or about 11/20/13, at Veolia Water North America-Caribbean, St. Thomas, VI. The employer did not implement their written hazard communication program to ensure labeling of portable containers (sprayers) and safety data sheets availability as follows: a. At the sludge handling area. Employees used and/or handled corrosive products such as Zep Industrial Purple Cleaner and Degreaser Concentrate (sodium hydroxide) during plant maintenance operations. b. At the scrubber system area. Employees used and/or handled corrosive products such Chlor Mor 3"tabs (calcium hypochlorite) during plant maintenance operations. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.

The employer did not ensure that portable containers (32 oz sprayers) of corrosive product such as Zep Industrial Purple Cleaner and Degreaser Concentrate (sodium hydroxide) were labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination when used and/or handled by employees during plant pipes maintenance operation.
