29 CFR 1926.62(d)(2)(i): Until the employer performed an employee exposure assessment, as required in 29 CFR 1926.62(d), the employer did not treat affected employee(s) as if they were exposed above the PEL, and not in excess of ten (10) times the PEL, and did not implement the protective measures prescribed in 29 CFR 1926.62(d)(2)(v), when affected employee(s) were performing inorganic lead paint removal covered by this requirement: Employees performing inorganic lead paint removal on a residential structure were exposed to lead inhalation and ingestion hazards and the employer did not provide the potentially exposed employee with protection of at least 10 times the PEL until the employee exposure assessment indicated the exposure level.
