OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: a) On September 25, 2013, and times prior thereto, in and around the sawmill in Whigham, GA, the employer failed to ensure that lumber-loader operators used seat belts, exposing employees to crush-by and entrapment hazards following a collision or tipover. Among other methods, one reasonable and acceptable means to correct the hazard, in accordance with ANSI B56.1, the employer could have complied with this national consensus safety standard for low-lift and high-lift trucks manufactured after 1992 to ensure that seatbelts were installed, and operators buckeled up daily. ABATEMENT CERTIFICATION IS REQUIRED.
