29 CFR 1926.451(b)(1):  Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, and the employer could not demonstrate that a wider space was necessary:  At the job site, 1602 N. Main, Hutchinson, Kansas, employee was working from the top working level of the framed scaffold south section without full planking.  Employees were exposed to fall hazards of approximatley 18 feet to the concrete surface.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  At the job site:  1602 N. Main, Hutchinson Kansas, employees were working from the following scaffold areas without a fall protection system in place.  Employees were exposed to fall hazards of approximately 18 feet.       a.  Employees were working from the Werner Aluminum work platform without a fall protection system in place.      b.  Employees were working from the south steel framed scaffold without the top guardrails in place.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  At the job site, 1602 N, Main, Hutchinson, Kansas, the employer did not inspect the scaffolds for visible defects by a competent person before employees began to work.  Fall protection systems and full planking were not in place.  Employees were exposed to fall hazards of approximately 18 feet.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:   At the job site, 1602 N, Main, Hutchinson, Kansas, the employer had not trained each employee to recognize fall hazards when working from welded framed scaffolds and aluminum planks and to implement fall protection systems to minimize fall hazards.  Employees were exposed to fall hazards of approximately 18 feet.
