29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 3 December 2013, and at times prior thereto, employees were exposed to an unprotected edge of the circular portion of a pedestrian ramp that had a chipped out section from the ramp wall, exposing the employees to a fall hazard of approximately 72 feet to the ground below.

29 CFR 1926.856(b): During demolition operation(s), floor openings did not have curbs or stop-logs to prevent the mechanical equipment from running over the edge. On or about 3 December 2013, and at times prior thereto, an operator was using a mini excavator with a jackhammer attachment to hammer out a section of the ramp floor, allowing it to fall down to the floor below. A curb or stop-log was not placed in front of the excavator prior to the floor collapsing, exposing the operator to a fall hazard of approximately 10 feet to the floor below.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where employees were exposed to hazards such as but not limited to struck-by, crushing, and fall from heights during demolition activities. On or about 3 December 2013, and at times prior thereto, employees engaged in demolition operations at Kyle Field Stadium were using a Caterpillar Skid Steer to load, maneuver and dispatch concrete debris. Hazards such as but not limited to struck-by, crushing, and fall from heights.
