OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees from the hazards of falls from elevations while working from unapproved forklift platforms: On or about December 3, 2013, a personnel work platform was utilized by a contractor on a JLG forklift for rigging up at the oil lease. The platform did not accommodate the insertion of the forks and was not adequately secured to the forklift. One feasible abatement method, among others, would be to ensure the platform conforms to the requirements of ITSDF B56.6-2005, Safety Standards for Rough Terrain Forklift Trucks as follows: (1) Post the maximum work load including personnel and equipment. (2) Post the weight of empty platform. (3) Provide a means to securely attach the platform to the lifting mechanism and forks, and to prevent the platform from inadvertent pivoting and/or sliding. (4) A rough terrain forklift truck shall not be used to lift people unless there is no other practical option. An aerial lift could be used.
