29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a.) Sami Super Abrasive Machining & Innovations LLC, "Tumbler Machine", on or about December 5th, 2013, and times prior thereto: A Quest Technology NoisePro Dosimeter was placed on an employee operating the Gemini brand Vibrating Finish Machine ("Tumbler") for a total sampling time of 369 minutes. Results indicated an equivalent 8-hr dose of 69.6% and Time Weighted Average (TWA) of 87.3 dBA, respectively. Exposure calculations included a zero increment for the 111 minutes not sampled.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a.) Sami Super Abrasive Machining & Innovations LLC, 20 Gillis Avenue, Ridgway, PA, 15853-Chemstation floor cleaning dispenser area-on or about December 5th, 2013, and times prior thereto: Company employees were working with and around corrosive chemicals including, but not limited to Chemstation brand #5019 during floor cleaning operations. An emergency eyewash and safety shower station was not available in the Chemstation floor cleaning dispensing area that was in compliance with ANSI 358.1-1998 for Emergency Eyewash and Shower Equipment in that: 1. An emergency eyewash and safety shower station that provides at least 15 minutes of flushing fluid to the eyes and/or body was not available in the area where there was potential for exposure to corrosive chemicals (Sodium hydroxide/proprietary surfactant blend) during dispensing operations of the Chemstation #5019 floor cleaner. One approximately 32 ounce saline bottle was being utilized by the company in lieu of an eye wash station and safety shower station that would be capable of providing at least 15 minutes of flushing fluid.
