The employee was not wearing any form of fall protection which exposed him to fall hazards of 6 feet or more.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed: On or about December 05, 2013, and at times prior thereto, one employee was working on the roof of a residential building. The ladder used to access the roof did have its side rails extended at least 3 feet above the landing. The employee was exposed to fall hazards of 6 feet or more to the ground below.
