29 CFR 1926.1412(d)(1): A visual inspection by competent person(s) was not conducted prior to each shift the equipment was used. Apparent deficiencies in the items noted in 1926.1412(d)(1)(i) thru (xiv), at a minimum, were not observed: a. On or about December 3, 2013, at the above addressed jobsite, employees were exposed to a crushing hazard from falling loads while working with a National Series 400 mobile hydraulic crane. The employer failed to ensure that an adequate visual inspection of the equipment was made by a competent person before each shift.

29 CFR 1926.1412(f)(1): At least every 12 months the equipment must be inspected by a qualified person in accordance with paragraph (d) of this section (each shift) except that the corrective action set forth in paragraphs (f)(4), (f)(5), and (f)(6) of this section must apply in place of the corrective action required by paragraphs (d)(2) and (d)(3) of this section: a. On or about December 3, 2013, at the above addressed jobsite, an annual inspection of the National Series 400 truck mounted crane had not been conducted and documented.
