29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: (a) Mancinas Custom at 403 Highland Avenue, Boulder, CO 80302: On and before 12/3/13, the employer did not develop a written hazrd communication program. This condition exposed employees to physical and health hazards associated with silica. Abatement Note: The requirements applicable to construction work under 29 CFR 1926.56 are identical to those set forth at 29 CFR 1910.1200 of this chapter. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. (a) Mancinas Custom at 403 Highland Avenue, Boulder, CO 80302: On and before 12/3/13, the employer did not provide employees with effective informaton and training on the hazards of silica while cutting flagstone. This condition exposed employees to physical and health hazards associated with silica. 29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace which includes a reasonable estimate of employee exposures to respiratory hazards: (a) Mancinas Custom at 403 Highland Avenue, Boulder, CO 80302: On and before 12/3/13, the employer did not evaluate the respiratory hazard of respirable crystalline silica during the stone cutting operation. Mancinas Custom employees were cutting flagstone for a new patio. This condition exposed employees to the respiratory hazards associated with respirable crystalline silica. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
