29 CFR 1910.95(c)(1):   The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95 (c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) Ammo Packaging Area: On or about December 11, 2013 and at times prior thereto, an employee working around the 45 Caliber Ammo packaging table was exposed to continuous noise levels in excess of the allowable 8-hour Time Weighted Average (TWA) sound level of 85 dbA. The employer did not implement an effective hearing conservation program. Noise sampling performed for 344 minutes indicated exposure to a 67.96% noise dose which is equivalent to approximately 87.2 dbA. Zero exposure was assumed for the 136 minutes not sampled.

29 CFR 1910.1025(d)(1)(ii): Full shift (for at least seven -7 continuous hours) personal samples for lead were not collected including at least one sample for each shift for each job classification in each work area:  (a) Facility: On or about December 11, 2013 and at times prior thereto, the employees were exposed to lead and no personal samples had been collected. One employee in the Sorting area had a lead exposure Time Weighted Average (TWA) of 22 micrograms per cubic meter of air (73% of the Action Level of 30 micrograms per cubic meter of air) during a 283 minute sample period.

29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  (a) Facility: On or about December 11, 2013 and at times prior thereto, the employer did not perform any air sampling to determine exposures to lead. An employee in the brass cartridge sorting and polishing area was exposed to lead levels at 73% of the Action Level of thirty micrograms per cubic meter of air. Personal air sampling performed for 283 minutes indicated an exposure to 22 micrograms per cubic meter of air, approximately 73% of the Action Level. Zero exposure was assumed for the 197 minutes not sampled.

29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:  (a) Sorting room: On or about December 11, 2013  and at times prior, employees were exposed to lead on the work bench in the manual sorting room where lead ghost wipe sampling identified lead to be 6764 ug/100 cm2 of surface area.   (b) Polishing room: On or about December 11, 2013 and at times prior, employees were exposed to lead on the  separator drum where lead ghost wipe sampling identified lead to be 956 ug/100 cm2 of surface area.  (c) Manual lead bullet loading room:  On or about December 11, 2013 and at times prior, employees were exposed to lead on the manual loading work bench top where lead ghost wipe sampling identified lead to be 343 ug/100 cm2 of surface area.  (d) Packaging Area:  On or about December 11, 2013 and at times prior, employees were exposed to lead on the QA Belt 40 where lead ghost wipe sampling identified lead to be 130 ug/100 cm2 of surface area.  (e) De Prime:  On or about December 11, 2013 and at times prior, employees were exposed to lead on the D-Prime work bench top where lead ghost wipe sampling identified lead to be 119 ug/100 cm2 of surface area.
