OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls: On or about December 12, 2013, an employee was exposed to a fall of approximately 28 feet while standing on the tine of a Skytrak Powered Industrial Truck (Model B8400; Serial P5606N577) to gain access to the top of a building currently under construction at IH-10 and Potranco Rd.
