29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On or about March 10th 2014, at the above addressed jobsite, the employer did not provide the information contained in the appendix D to employees using a 3M N95 filtering facepiece respirator while performing boat sanding operations.

29 CFR 1910.1200(h): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and -2 on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced: On or about March 10th 2014, at the above addressed job site, the employer, did not provide hazard communication training to all employees while performing boat sanding operations and being exposed to respirable dust and metals such as, but not limited to Zinc Oxide and Copper.
