29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of the jobsite, materials, and equipment to be made by a competent person: (a) Journey Homes, LLC @ 413 E. 29th Street Drive, Greeley, CO. 80631. On and before December 12th, 2013, the controlling employer did not ensure that a competent person conduct inspections of the jobsite to ensure that fall protection systems were utilized by subcontractor employees to protect them from fall hazard when working from roofs and other elevations. As part of the injury/accident prevention responsibilities, the controlling employer did not ensure subcontractors were using fall protection while working from a 4-in-12 slope roof on a two-story residential home under construction. This condition exposed the employees to a fall hazard of approximately 14 feet eave to ground. Abatement note: The requirements and duties of a competent person are: (1) A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them. (2)The competent person must understand and be able to carry out the tasks specified in the OSHA standard. The competent person must have knowledge about fall protection systems or plans, and the safety program.

29 CFR 1926.501(b)(4)(ii): Each employee on walking/working surfaces shall be protected from tripping in or stepping into or through holes (including skylights) by covers: (a) Journey Homes, LLC @ 413 E. 29th Street Drive, Greeley, CO. 80631: On and before December 12th, 2013, the controlling employer did not ensure that each window well on the two-story residential home under construction was provided with a cover to safeguard employees from tripping in or stepping into the hole, which measured 3x8 feet wide and 5 feet deep. Abatement Note: All covers shall be: (1)Secured when installed so as to prevent accidental displacement by the wind, equipment, or employees. (2)Color coded or they shall be marked with the word "HOLE" or "COVER" to provide warning of the hazard.
