29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) (a) O'Hare Cargo Building #517 - In the warehouse: The employer failed to ensure that all powered industrial trucks that were found to be in need of repair or were in anyway unsafe were removed from service until they had been restored to a safe operating condition. Instance #1: The Komatsu Forklift LH 273, had damaged forks, one fork measured approximately 57.5 inches, and the other fork measured approximately 59.5 inches. Instance #2: Komatsu Forklift LH 2710, had a damaged seatbelt and damage to the forks, the edge of the fork was curled upward, and the other fork was worn thin and approximately four inches shorter. Instance #3: Komatsu Forklift LH 2722, had damage to the forks, the forks were worn and at an uneven height.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. (a) O'Hare Cargo Building #517 - In the warehouse: The employer failed to ensure that all industrial trucks were inspected for damage after each shift and before being placed in service.
