29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:         a.)    Richard A. McMahon dba Beals-McMahon Painting, 2 East 3rd Avenue, Warren, PA, 16365-on or about November 25, 2013, and times prior thereto:  Company employees voluntarily used 3M brand half mask respirators with organic vapor cartridges (#6001) while working next to drywall buffing operations.  Appendix D of 29 CFR 1910.134 had not been provided to the respirator users.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:         a.)Richard A. McMahon dba Beals-McMahon Painting, 2 East 3rd Avenue, Warren, PA, 16365-on or about November 25, 2013, and times prior thereto:  Company employees voluntarily used 3M brand half mask respirators with organic vapor cartridges (#6001) while working next to drywall buffing operations.  The company's written respiratory protection program did not identify the physician or PLHCP who would provide company employees with a medical evaluation/examination.

29 CFR 1910.134(h)(1)(i): Respirators issued for the exclusive use of an employee were not cleaned and disinfected as often as necessary to be maintained in a sanitary condition:         a.)Richard A. McMahon dba Beals-McMahon Painting, 2 East 3rd Avenue, Warren, PA, 16365-on or about November 25, 2013, and times prior thereto:  Company employees voluntarily used 3M brand half mask respirators with organic vapor cartridges (#6001) while working next to drywall buffing operations.  The employee's respirator was not maintained in a sanitary condition as evidence by the fact that paint residues were observed on the inside of the facepiece of the employee's half mask respirator.
