OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from and/or crushed by the forklift. (a) Parking lot of 700 W. State St. Boise, ID: On or about December 16, 2013, and at times prior thereto, the employer did not provide and ensure use of a seatbelt for the operator(s) of the Nissan 35, SN# KPH01A18PV. Note: Abatement certification and documentation ARE required for this item.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service: (a) On or about December 16, 2013 and at times prior thereto, the Nissan 35 forklift (SN# KPH01A18PV) was not examined to determine if there was a properly functioning seat-belt for the operator to wear. (b) On or about December 16, 2013 and at times prior thereto, the Nissan 35 forklift (SN# KPH01A18PV) was not examined to determine if the tire pressure in the front, pneumatic tires was adjusted properly. (c) On or about December 16, 2013 and at times prior thereto, the Nissan 35 forklift (SN# KPH01A18PV) was not examined to determine if damaged overhead guard maintained structural integrity. (d) On or about December 16, 2013 and at times prior thereto, the Nissan 35 forklift (SN# KPH01A18PV) was not examined to determine if the operator's manual was present and in legible condition. Note: Abatement certification IS required for this item.
