29 CFR 1910.67(b)(2): A modified aerial lift(s) was not certified by the manufacturer or NRTL as being at least as safe as the equipment was before modification: a) On or about 12/16/13 at the Kistner Concrete Products Plant located on Route 39, Springville, New York; employees repairing a conveyor belt attached the belt to the boom of a Grove MZ90 extensible boom lift to hold the belt during repairs. The extensible boom lift was not designed or certified for material handling or lifting. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: a) On or about 12/16/13 at the Kistner Concrete Products Plant located on Route 39, Springville, New York; employees repairing a conveyor belt were using a Grove MZ90 extensible boom lift to anchor the conveyor belt. The employee was not weaaring a body belt/harness with a lanyard and was thrown from the basket. NO ABATEMENT CERTIFICATION REQUIRED
