29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.(a)(LOCATION)(IDENTIFY SPECIFIC OPERATIONS AND/OR CONDITIONS)(DESCRIBE HAZARD(S) WHERE NECESSARY) On or about December 17, 2013, at a job site located at 1201 Main Street, Little Rock, AR, on a low-sloped metal roof, the employer did not ensure employees were protected from falling by use of fall protection systems, while they were waterproofing the roof. This practice exposed the employees to fall hazards of approximately 14 feet to the ground below.

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function: On or about December 17, 2013, at the center of the low-sloop roof, the employer did not ensure that the foreman/safety monitor was not distracted from his monitoring activities. Instance a: Foreman/Safety Monitor was bent over at the leading edge of the roof helping employees apply waterproofing on roof damage areas. This created a condition which exposed employees to unprotected falls of 14 feet to ground below. Instance b: Foreman/Safety monitor was greater than 6 feet away from employee with head down applying waterproofing material, while other employees were in close proximity to the north and south edges of the roof. This created a condition which exposed employees to unprotected falls of 14 feet to ground below.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) On or about December 17, 2013, at the jobsite, the employer did not provide hard copies of safety data sheets for each hazardous chemical present in use, including such as caulk, adhesive and sealant and make them readily accessible at the jobsite for immediate access without barriers such as, but not limited to, electronic access and at the main office.
