OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential struck-by hazards. a) For the Padgett-Swann Machinery Co. facility at 5128 S 36 Ave, Tampa, FL 33619, as observed on or about 12/18/2013, employees used overhead cranes to pick up and transport marine propellers weighing multiple tons. Safety latches on hoist and chain hooks at the facility were either broken or missing. Employees were exposed to potential struck-by hazards while moving material with cranes/hooks.

29 CFR 1910.212(a)(5): Fan blade guards, where the periphery of the blades was less than seven feet above the floor or working level, had openings larger than one half inch: a) For the Padgett-Swann Machinery Co. facility at 5128 S 36 Ave, as observed on or about 12/18/2013. The perimeter of the metal housing around the portable fan was badly damaged causing a gap between it and the blade guard of about 1.5 inches. Employees were exposed to severe lacerations to their fingers.
