29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about December 13, 2013, at Cajun Sugar in New Iberia, LA; the employer failed to establish a fully compliant energy control program in that energy control procedures, employee training, and periodic inspections were not sufficient to ensure that the Crusher Donnely Chute and/or mill roller were securely isolated from any and all energy sources before the commencement of service and/or maintenance activities.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): On or about December 13, 2013, at Cajun Sugar in New Iberia, LA; the employer failed to clearly and specifically outline the methods to be used in controlling hazardous energy, including specific statements of intent, procedural steps for shutdown, procedural steps for locking out, and requirements for testing the effectiveness of energy control measures being used. Because the energy control procedure was too general, each employee engaged in a servicing/maintenance activity (i.e., cleaning the mill roller inside of the Crusher Donnely Chute) was not adequately protected from the unexpected energization or start-up of the mill.
