29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures for voluntary respirator users:     a) Bryn Hill Industries, Inc.: The employer did not develop a written respiratory protection program for those employees who voluntarily wore tight-fitting, half-face, negative pressure, elastomeric respirators. These employees were observed spraying urethane and other foam products while working on the production line. This was observed on January 28, 2014.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or used the respirator in the workplace:     a) Bryn Hill Industries: The employer supplied and allowed employees to purchase elastomeric, tight-fitting, negative pressure, half-face respirators for voluntary use and comfort while they sprayed isocyanate containing chemicals in the production area of facility. The employer did not ensure that the employees were provided with a medical evaluation prior to donning the respirators. This was observed on January 28, 2014.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) Bryn Hill Industries, Inc.: Employees were provided and used chemicals such as, but not limited to, Suprasec 2722, which contains Diphenylemethane 4,4-diisocyanate, Diphenylmethane-2,4-diisocyanate, and Methylenediphenyldiisocyante. The employer did not provide the employees, upon hire, training regarding the hazards of the chemicals used.This was observed on January 28, 2014.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:       a) Bryn Hill Industries, Inc.: The employer did not provide employees who donned N95 particulate respirators (Model #1501) with Appendix D of the respiratory protection standard. The employees voluntarily donned the respirators without being provided information regarding information concerning the appropriate use.This was observed on January 28, 2014.       b) Bryn Hill Industries, Inc.: The employer did not provide employees who donned tight-fitting, elastomeric, half-face respirators (Model #7507) with Appendix D of the respiratory protection standard. The employees voluntarily donned the respirators without being provided information regarding information concerning the appropriate use. This was observed on January 28, 2014.

29 CFR 1910.1200(e)(1)(i): The written hazard communication program did not include a list of the hazardous chemicals known to be present, using an identity that was referenced on the appropriate material safety data sheet:  a) Bryn Hill Industries, Inc.: The employer presented a chemical inventory list which did not include all of the newly listed or updated hazardous chemical products which were being supplied and used by the employees. The products include, but were not limited to Rubinate 7507 containing Diphenylmethane 4,4-disocyanate and Rubiflex 31746 containing Dimethylaminopropylamine. The product numbers which were identified on the chemical inventory sheet referenced a similar product previously purchased and used by the employees. This was observed on January 28, 2014.
