29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.   There was no frequent and regular inspection program being maintained in use by a competent person knowledgeable of roofing fall protection regulation requirements to ensure the job site, materials and equipment such as residential apartment roofing fall protection devices and or systems were being maintained and utilized in a safe condition.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Located along various areas of the residential apartment three story roof deck with a slope greater than 4 in 12 employees were observed performing roofing tear off associated work activities without conventional fall protection and were exposed to unprotected side or edge fall potentials in excess of 28'.
