29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about December 18, 2013, at the jobsite, an employee working on scaffolding was exposed to head impact hazards from employee overhead installing bricks while the other employee was handing bricks to him for installation.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about December 18, 2013, on a roof, at the jobsite, the employer did not ensure that each employee working and walking on wood-framing were protected from falling 11 feet by a fall protection system. Alternative fall protection system use was not attempted. Employee was installing exterior brick on a roof dormer, while working on a 2 x 10 inch scrap piece of lumber at an elevation of 11 feet. This practice created a condition that exposed the employee to fall hazards of 11 feet to the unfinished ground below.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about December 18, 2013, the employer did not ensure the aluminum extension ladder extended three feet above the roof landing. The employees used the ladder to access the roof while performing masonry activities of a 1 story, residential structure. This condition exposed the employee's to the hazard of stumbling and falling from the ladder 11 feet to the ground below.
