29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  a) Work site - On or about December 19, 2013, an employee was using a pneumatic nail gun to install roofing material without wearing impact resistant eye wear to provide protection from the flying nails and debris.  The Damian Soler Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 905901, citation number 1, item number 1 and was affirmed as a final order on October 22, 2013, with respect to a workplace located at 101 Declaration Drive, Bethlehem, PA.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  a) Roof - On or about December 19, 2013, an employee was working on a roof with a 9/12 pitch, no less than 10 feet above a lower level, and was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Damian Soler Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 905901, citation number 1, item number 2a  and was affirmed as a final order on October 22, 2013, with respect to a workplace located at 101 Declaration Drive, Bethlehem, PA.

29 CFR 1926.1053(b)(1):   Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  a) Front access to roof - On or about December 19, 2013, employees were accessing the roof of a residence using an extension ladder that did not extend at least three feet above the upper landing surface nor was secured to prevent displacement and used with a grasping device.   The Damian Soler Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 905901, citation number 1, item number 3 and was affirmed as a final order on October 22, 2013, with respect to a workplace located at 101 Declaration Drive, Bethlehem, PA.
