OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:    On or about 12/18/2013, Storage Area    a) The employee from S & K Distribution, LLC (dba New Castle Building Product) used a Toyota forklift (model 8FGU 25) to elevate an employee approximately 10' high, to repair a heater. The forklift operator placed a pallet of shingles on the forks to create a work platform. The platform did not meet the requirements for elevating personnel, was not secured to the forks and fall protection was not provided. The employee was exposed to a 10' fall hazard.      Among other methods, feasible and accepted methods to correct these hazards are to:  1) comply with safety rules described in the operations manual for the Toyota forklift.    2) Follow ANSI B56.1 -2012, Safety Standard for Low Lift and High Lift Trucks, paragraph 4.17.1  Elevating Personnel and paragraph 7.37.1 Platforms: Elevating.
