29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Near 2794 Ross Clark Circle, Dothan AL; On or about December 18, 2013 the employer exposed employees to worksite hazards in that the employer failed to instruct his employees in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to their work environment to control or eliminate any hazard(s) or other exposure to illness or injuries. Employees were working in a 6.6 foot deep trench without any safety training regarding trenching and excavation work.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Near 2794 Ross Clark Circle, Dothan AL; On or about December 18, 2013 the employer exposed employees to head injuries in that employees were allowed to work underneath the bucket of a track hoe which was moving dirt out of the excavation they were working in without helmets for head protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) Near 2794 Ross Clark Circle, Dothan AL; On or about December 18, 2013 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring 6.6 feet deep, 15 feet wide, and 17 feet in length that was dug in class "c" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal) on all sides.
