29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:      On or about December 17, 2013, at an apartment complex construction site, subcontract employees did not wear a protective head gear while working on site. Employees were exposed to the hazard of being struck by falling objects.

29 CFR 1926.1053(b)(1):  A portable ladder used for access to an upper landing surface did not have the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.          On or about December 17, 2013, at an apartment complex construction site, employees of a subcontractor were allowed to use ladders that were not extended 3 feet above the point of contact or secured to the structure to ensure safe access/egress. Employees were exposed to the hazard of falls.        Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps that is taking to ensure that ladders are extended at least 3 feet above the point of contact.

29 CFR 1926.453(b)(2)(v):  A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift.      On or about December 17, 2013, at an apartment complex construction site, subcontract employees were observed working from an aerial lift without fall protection, exposing the employees to the hazard of falls.          Case Development was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 312385685, citation number 1, item number 4, and was affirmed as a final order on December 4, 2009, with a final abatement date of November 13, 2009, with respect to a workplace hazard at 7845 S. Union Ave. Tulsa, OK 74132.      Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps that is taking to ensure that employees working in baskets of aerial lifts are protected from falls or ejection by the use of harnesses.

29 CFR 1926.501(b)(13):  Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure:    a)  On or about November 21, 2013, at an apartment complex construction site, subcontract employees were observed performing residential construction activities without fall protection. Employees were exposed to the hazard of falls from elevation.    b)  On or about December 17, 2013 and at times prior there to, at an apartment complex construction site, subcontract employees were observed performing residential construction activities without fall protection. Employees were exposed to the hazard of falls from elevation.     Case Development was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 313690158, citation number 1, item number 3, and was affirmed as a final order on May 24, 2010, with a final abatement date of May 10, 2010, with respect to a workplace hazard at 301 Pointe Parkway Blvd, Oklahoma City, OK 73099.        Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps that is taking to ensure employees conducting residential construction activities are protected by personal fall arrest systems or other fall protrection means.
