29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  On December 24, 2013, about 1000, lower level rear of building.  (a)Employer did not ensure demolition and construction debris was removed from the building daily. The large pile of debris cluttered the walkways and work space of the first floor. Stacks of tools and materials in every room on the first floor created an unsafe working condition.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.  Location: On December 24, 2013, at 171 Metropolitan Ave, Brooklyn, on first floor rear of structure.  (a)Employees were using temorpary flexible extension cords to energize electric power tools, radio and cell phone charging station. The power strip utilized was plugged into an extension cord which was not protected by proper ground fault circuit interrupter.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.405(a)(2)(ii)(E): All lamps for general illumination shall be protected from accidental contact or breakage. Metal-case sockets shall be grounded.  Throughout the first floor and cellar area of the project, 171 Metropolitan Ave, Brooklyn, NY  a). Employees were working within a Gut/Rehab project utilizing temporary lighting to illuminate the work site, the lights were not protected against accidential contact or breaking by a cage system around the bulb. 29 CFR 1926.405(a)(2)(ii)(F): Temporary lights shall not be suspended by their electric cords unless cords and lights are designed for this means of suspension. Employees were exposed to electric shock hazards by the temporary lighting hanging from its own wires, this type of lighting was not designed for self hanging conditions. 29 CFR 1926.651(i)(2)(iv): A registered professional engineer has approved the determination that such excavation work will not pose a hazard to employees.  Location 171 Metropolitan Ave, Brooklyn, basement level of the project.  a). Employees had excavated outside the rear wall of the basement of the structure. Had removed several cubic yards of earth and began erecting a concrete block wall at perimeter rear wall.  There was no engineer approved plans or written description of hte work being performed.   NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

(a) Employees had excavated the rear exterior wall of the basment and piled the spoils from the excavation on the sidewalk immediately adjacent to the excavation. The Spoil pile was within 3 inches of excavation and was falling back into the hole during removal of the dirt pile. 29 CFR 1926.854(d): Employer did not ensure that Structural or load-supporting members of the first floor system were not cut or removed until all stories above such a floor had been demolished and removed. Employees had cut the outside corner post of the temporary floor support which was more than 12 feet from teh next floor support leaving the exterior three story wall of the project unprotected from collapse.  Location: 171 Metropolitan Ave, Brooklyn, NY rear wall of project.  A) Employees had cut the temporary 2x4 stud supporting the mid span floor joist support at the basement level thereby eliminating the point load support for the three story exterior wall above.    NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
