29 CFR 1910.29(a)(3)(vii): All work levels 10 feet or higher above the ground or floor shall have a guardrail of 2- by 4-inch nominal or the equivalent installed no less than 36 inches or more than 42 inches high, with a mid-rail, when required, of 1- by 4-inch nominal lumber or equivalent:  On or about December 23, 2013, at the above located workplace, employees were required to access mobile tubular scaffolds, approximately ten (10) feet high, during roof repair of the trailers. The scaffold did not contain a standard railing, thereby exposing employees to the hazards associated with falls.

29 CFR 1910.215(a)(2): Guard design. The safety guard shall cover the spindle end, nut, and flange projections. The safety guard shall be mounted so as to maintain proper alignment with the wheel, and the strength of the fastenings shall exceed the strength of the guard:  a. On or about December 23, 2013, at the above located workplace, employees performing metal grinding operations did not have safety guards that covered the spindle end, nut and flange projections on the 6-inch bench grinder. Employees were thereby exposed to the hazards associated with rotating abrasive wheels and wheel breakage.

29 CFR 1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion:  a. On or about December 23, 2013, at the above located workplace, employees performing metal grinding operations did not have an adjustable work rest on the 6-inch bench grinder. Employees were thereby exposed to the hazards associated with rotating abrasive wheels and wheel breakage.

29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.):  a. On or about December 23, 2013, at the above located workplace, employees performing metal grinding operations did not have an adjustable tongue at the top of the 6-inch bench grinder. Employees were thereby exposed to the hazards associated with rotating abrasive wheels and wheel breakage.

29 CFR 1910.253(a)(3): Apparatus. Only approved apparatus such as torches, regulators or pressure-reducing valves, acetylene generators, and manifolds shall be used:  a. On or about December 23, 2014, at the above located workplace, employees working near the oxygen and acetylene compressed gas cylinders were exposed to struck-by and fire hazards due to broken regulators on both cylinders. The compressed gas cylinders used in the facility did not have the glass covering the pressure display and was not approved by the manufacture.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour:  a. On or about December 23, 2014, at the above located workplace, compressed oxygen cylinders were stored near the flammable welding gas cylinders. The oxygen cylinders were not separated a minimum of 20 feet from the flammable compressed gas cylinders. Employees were thereby exposed to the hazards associated with fire and explosion.

29 CFR 1910.254(d)(9)(iii): Cables with damaged insulation or exposed bare conductors shall be replaced. Joining lengths of work and electrode cables shall be done by the use of connecting means specifically intended for the purpose. The connecting means shall have insulation adequate for the service conditions:  [55 FR 13709, Apr. 11, 1990; 61 FR 9227, March 7, 1996; 70 FR 53929, Sept. 13, 2005]  a. On or about December 23, 2014, at the above located workplace, employees were required to perform welding operations with cables that showed damage to their insulation or exposed bare conductors. Employees were thereby exposed to electrical hazards. The welding machines cables locations were the following:    1. South wall / Center  the welding lead (+) had insulation damaged with exposed cable.  2. North wall  the grounding cable to the welding machine had insulated damage with exposed cable.

29 CFR 1910.334(a)(2)(ii): If there is a defect or evidence of damage that might expose an employee to injury, the defective or damaged item shall be removed from service, and no employee may use it until repairs and tests necessary to render the equipment safe have been made:  a. On or about December 23, 2013, at the above located workplace, employees were required to use extension cords on a daily basis. The insulation of the extension cords were visually damaged, not intact and had not been removed from service. Employees were exposed to the hazards associated with electricity.

Self-luminous or electroluminescent signs that have a minimum luminance surface value of at least .06 footlamberts (0.21 cd/m2) are permitted:  a. On or about December 23, 2013, at the above located workplace, employees were required to work on the east side of the facility. The exit sign above the exit route was not illuminated, thereby exposing employees to the hazards associated with fires or other emergencies.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:  a. On or about December 23, 2013, at the above located workplace, employees were required to perform task such as, but not limited to welding, torching, and grinding. These tasks necessitated the use of personal protective equipment such as safety glasses and gloves to prevent occupational injuries or illnesses. The employer had not verified, through written certification, that a hazard assessment had been performed.
