29 CFR 1926.451(g)(1)(iv): Each employee on a self-contained adjustable scaffold was not protected by a guardrail system.  a) At the jobsite, on or about and at times prior to December 26, 2013, the employer did not ensure employees who were performing overhand brick work on a commercial building from a three tier tubular welded scaffolding system that measured approximately twenty six feet in height was protected from fall hazards through the application of end rails, exposing the employees to the hazards associated with death, broken bones, sprains, lacerations, and bruises.  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.178(l)(3)(ii)(I): Powered industrial truck operators did not receive initial training in other unique or potentially hazardous conditions of the workplace that could affect safe operation:  a) At the jobsite, on December 26, 2013, the employer did ensure that a powered industrial truck operator was sufficiently trained to understand the hazards associated with leaving an elevated steel waste material bin elevated at a height of greater than ten feet while the cab of the powered industrial truck was unmanned, exposing employees to the hazards associated with death, crushing, and struck-by injuries.  ABATEMENT CERTIFICATION IS NOT REQUIRED

The company did not maintain the logs before the date of the inspection.  ABATEMENT CERTIFICATION IS REQUIRED
