OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from a fall from heights, caught in between and struck-by hazards: At the worksite: On or about December 16, 2013, the employer allowed employees to work from a work platform supported by a rough terrain forklift in a manor that did not meet the forklift manufacturers guidelines and requirements. Employees were exposed to fall from heights, caught in between and struck-by hazards.
