29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Worksite, 599 Jericho Tpke., St. James- Employees were not wearing head protection while exposed to being struck by overhead materials such as, but not limited to hand tools and connecting hardware being used by workers overhead; on or about 12/27/13.  b) Worksite, 599 Jericho Tpke., St. James- Employees were not wearing head protection while exposed to struck-by hazards while working alongside a crane as they connected a beam to the crane hook in preparation for lift; on or about 12/27/13.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Worksite, 599 Jericho Tpke, St. James, NY- an employee was observed standing at the top of a concrete foundation approximately 12 feet above the ground below and was not protected from falling by the use of guardrail, safety net or personal fall arrest systems; on or about 12/27/13.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.760(b)(3): Each connector working at heights over 15 and up to 30 feet above a lower level, was not provided with a personal fall arrest system, positioning device system or fall restraint system and wear the equipment necessary to be able to be tied off; or was not provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section.  a) Worksite, 599 Jericho Tpke., St. James, NY- two employees were working at a height of approximately 24 feet above the ground below while engaged in connecting steel beams without the equipment necessary to be tied off; on or about 12/27/13.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

The employees did not regonize the hazard in doing so; on or about 12/27/13.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
