Section (5)(a)(1): The employer did not furnish a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential caught in or struck by hazards:  (a) On or about December 18, 2013 and dates prior to for employees operating the FMV-1000 CNC Machining center where the interlock device was removed at the workplace located at 500 Ordway Avenue in Minto, North Dakota.  Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the ANSI B11.23-2002, American National Standards Institute- Safety Requirements for Machining Centers and Automatic, Numerically Controlled Milling, Drilling and Boring Machines, which specifically addresses the requirement for interlocked safety guards.  Paragraph 6.21 for Safeguarding states, "Machines shall be safeguarded whenever practicable by fixed or interlocked moveable guards".  Paragraph 6.21.1.2 for Automatic Mode states, Machine operation shall only be possible when the guards are closed and the safeguarding (protective) devices are active.  If it is possible, in this mode, to open an interlocked moveable guard, the hazardous movements shall cease and be inhibited.  Also, paragraph 6.21.1.1 for Work Zones, General states, Measures to minimize possible defeat of interlocking shall be taken.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)  On or about December 18, 2013 and dates prior to for employees exposed to struck-by hazards where the No. 5 Warner & Swassey lathe did not have a chip guard installed at the workplace located at 500 Ordway Avenue in Minto, North Dakota.  (b) On or about December 18, 2013 and dates prior to for employees exposed to struck-by hazards while pressing out bushings with the two hydraulic presses, where the presses do not have barriers to protect employees from dislodged and flying parts at the worksite located at 500 Ordway Avenue in Minto, North Dakota.
