29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    (a)GHP Enterprises, LLC @ 3660 So. Beeler Street, Denver, CO 80237: On or before January 2nd, 2014, as part of the injury/accident prevention responsibilities, the controlling employer did not ensure each employee who was allowed to operate the All-Terrain Forklift (Genie model # GTH 644) was trained in the safe operation as required under the standard. The jobsite supervisor and a framing subcontractor employee operated the rough terrain forklift without receiving training to ensure that each operator is competent to operate a powered industrial truck. This condition exposed an employee and a subcontractor employee to the hazard of improper forklift operation.      29 CFR 1926.602(d): Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 29 CFR 1910.178(l) of this chapter.    Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one stair rail system along each unprotected side or edge:      (a) GHP Enterprises, LLC @ 3660 So. Beeler Street, Denver, CO 80237: On and before January 2nd, 2014, the controlling employer did not ensure that each stairway(s) used by employees and subcontractor employees to gain access to the 2nd & 3rd floor of the 3-story residential building under construction, was provided with one stair rail system along each unprotected side or edge.  Every stairway used for access to upper levels in the building were not equipped with stair rail systems along each unprotected side or edge. This condition exposed the employees to fall hazards of approximately 10 feet when ascending and descending the stairways.
