29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides.  The employer does not guard open-sided floors four feet or more above an adjacent floor or ground level. This violation occurred on or about January 07, 2014, in the manufacturing area where employees were exposed to a fall hazard when storing boxes at the mezzanine level near an open-sided floor without guardrails or equivalent protection.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 4 feet or more above the floor or ground level.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  The employer does not guard machines to protect employees from hazards of ingoing nip points and rotating parts. This violation was observed on or about January 07, 2014 in the manufacturing area where employees were exposed to a caught-in hazard when working around the motorized rollers of the duct maker machines that were not guarded.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that guards are installed on all machines to protect employees.

This violation was observed on or about January 07, 2014 in the manufacturing area where employees were working without the emergency exits marked or clearly visible.     Pursuant to 29 C.F.R., within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all emergency exits and non-exits are properly identified with signage.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  The employer does not ensure that each operator successfully completes training consisting of a combination of formal instruction and practical training.  This violation occurred on or about January 07, 2014, and at times prior thereto, when employees in the facility were required to operate forklifts without successfully completing formal and practical operator training.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each operator successfully completes the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), and practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.
